1. About These Terms

Welcome to Bookish by Cat.

These Terms & Conditions apply when you access the Bookish by Cat website, place an order, purchase a product or otherwise use our online store.

Please read these Terms carefully before placing an order.

By purchasing from Bookish by Cat, you agree to these Terms together with our:

Privacy Policy
Shipping & Delivery Policy
Returns, Cancellations & Refunds Policy

Nothing within these Terms is intended to exclude, restrict or otherwise affect your statutory consumer rights.

Bookish by Cat offers bookish Mystery Bundles, Seasonal Boxes, bookish add-ons, accessories and related products.

The Bookish by Cat online store is hosted using Shopify.

Purchases made through the Bookish by Cat website are contracts between the customer and Bookish by Cat. Shopify provides the ecommerce technology used to operate the store but is not the seller of Bookish by Cat products.

3. Our Products

Bookish by Cat may offer products including:

Mystery Bundles
Seasonal Boxes
Standard Bookish Pick Add-Ons
Deluxe Bookish Pick Add-Ons
Double Bookish Pick Add-Ons
Bookish accessories
Gifts
Other bookish, seasonal or related products introduced from time to time

The nature, contents, quantity and price of each product will be described on the relevant product page.

We make reasonable efforts to ensure product descriptions, photographs and other information displayed on our website are accurate.

However:

Colours may appear slightly different due to lighting, photography, screen settings and devices.
Some products may be handmade or individually finished and minor variations may occur.
Photographs of Mystery Bundles are examples only unless expressly stated otherwise.
Designs, patterns, colours or brands may vary where this is stated in the product description.

Nothing within this section affects your statutory rights where goods are faulty, damaged, unsafe, incorrectly supplied or materially different from their description.

4. Mystery Bundles

Bookish by Cat Mystery Bundles are created using our mystery capsule selection system.

Products are separated into Standard and Deluxe categories. Capsules contain the item type to be included in the bundle and are selected without Bookish by Cat knowing which particular item type is inside before the capsule is opened.

The bundle purchased determines the number and balance of Standard and Deluxe selections.

The element of surprise is therefore an intentional and fundamental part of a Mystery Bundle.

By purchasing a Mystery Bundle, you acknowledge that:

Item types are selected at random.
Contents will vary between orders.
Colours, brands, patterns, styles and designs may vary.
Specific products cannot be guaranteed unless expressly stated otherwise.
Product photographs are illustrative examples and do not represent the exact contents of your bundle.
Another customer's bundle may contain completely different products.
The relevant product page will state the number of mystery items included.

Receiving a randomly selected product, colour, pattern, design or style that you personally dislike does not mean that the product is faulty, incorrect or not as described where the Mystery Bundle otherwise conforms to its description.

This does not affect any statutory cancellation, return or faulty-goods rights applying to your purchase.

5. Preferences and Exclusions

Customers purchasing a Mystery Bundle may be invited to provide information about their preferences.

This may include:

Favourite colours
Themes
Book genres
Styles
Bookish aesthetics
Likes and dislikes
Items or themes they would prefer not to receive

Once the mystery capsules have been selected, Bookish by Cat will use this information to curate the final products from available stock wherever reasonably possible.

Preferences are intended to help personalise the overall feel of the bundle. They do not allow customers to select specific mystery products.

Requests for particular products, characters, fandoms, brands, designs, themes or colours cannot be guaranteed unless the relevant product page expressly says otherwise.

Where you tell us that there is something you do not want included, we will make reasonable efforts to respect that request when curating your bundle.

6. Seasonal Boxes

Bookish by Cat may offer Seasonal Boxes throughout the year.

Seasonal Boxes operate differently from Mystery Bundles. Their principal contents will generally be stated on the relevant product page so customers can see what is expected to be included before ordering.

Seasonal Boxes may also include additional surprise items that are intentionally not revealed in advance.

Depending on the relevant listing:

Colours may vary.
Designs or patterns may vary.
Drink options may be offered.
Particular styles may depend on available stock.
Certain products may be exclusive to that Seasonal Box.

If a specific advertised item unexpectedly becomes unavailable, Bookish by Cat may offer a suitable alternative where the possibility of substitution was clearly disclosed.

Any substitute will be selected with the intention of maintaining the overall nature and value of the product.

Where a proposed substitution would materially change what you purchased, Bookish by Cat may contact you before dispatch or offer an appropriate cancellation/refund option rather than simply making a materially different substitution.

Seasonal Boxes may be produced in limited quantities and are not guaranteed to be restocked once sold out.

7. Drinks Included with Products

Where a product states that a drink is included as standard, available choices may include tea, coffee or hot chocolate.

Customers should provide their preferred option using the personalisation box on the relevant product page where available.

Drink choices are subject to the options and availability stated on that product page.

Food and drink allergy information should always be checked before consumption.

8. Personalisation Boxes and Special Requests

Certain Bookish by Cat products include a personalisation box.

Customers may use this box for matters such as:

Providing Mystery Bundle preferences.
Providing colours, themes or styles they like.
Identifying something they would prefer not to receive.
Selecting an advertised drink option.
Requesting a handwritten gift note.
Providing a social-media username where relevant.
Making another small request relating to the order.

Bookish by Cat will always do its best to accommodate reasonable requests where possible.

However, unless the product page expressly provides a guaranteed option, submission of a request does not guarantee that it can be fulfilled.

Specific product swaps, brands, designs, fandoms, themes or colours cannot normally be guaranteed due to the mystery nature of our products and available stock.

9. Handwritten Gift Notes

Where available, customers may request a free handwritten gift note by entering their message into the personalisation box on the relevant product page.

The customer is responsible for checking the wording submitted.

Bookish by Cat reserves the right to refuse to reproduce any message that contains content that is:

Threatening
Abusive
Discriminatory
Hateful
Harassing
Unlawful
Grossly offensive
Otherwise reasonably considered inappropriate

Requesting a handwritten gift note does not automatically make the other goods within the order personalised for the purposes of statutory cancellation rights.

ADD-ONS

10. Mystery Bundle Add-Ons

Standard, Deluxe and Double Bookish Picks are add-on products and must be purchased alongside an eligible Mystery Bundle unless expressly stated otherwise.

They are not intended to be purchased as standalone products.

If more than one Mystery Bundle is contained in the same order, customers should use the personalisation box to tell us which Mystery Bundle the add-on should be included with.

If no instruction is provided, Bookish by Cat will use reasonable judgement when allocating the add-on.

11. Standard Bookish Pick

A Standard Bookish Pick adds one additional randomly selected Standard capsule to an eligible Mystery Bundle.

Examples may include:

Bookmarks
Pens and pencils
Mini notebooks
Annotation accessories
Sticky notes
Stationery
Scrunchies
Stickers
Other bookish accessories

Examples are illustrative only and do not guarantee a particular item.

12. Deluxe Bookish Pick

A Deluxe Bookish Pick adds one additional randomly selected Deluxe capsule to an eligible Mystery Bundle.

Examples may include:

Drinkware
Candles
Tote bags
Pencil cases
Wax melts
Premium bookmarks
Reading lights
Socks
Lanyards
Kindle or phone grips
Other premium bookish products

Examples are illustrative only and do not guarantee a particular item.

13. Double Bookish Pick

A Double Bookish Pick includes:

One randomly selected Standard capsule; and
One randomly selected Deluxe capsule.

This adds two additional mystery products to an eligible Mystery Bundle.

Specific products cannot be guaranteed.

SOCIAL MEDIA AND PACKING VIDEOS

14. Packing Videos

Bookish by Cat may film orders while they are being selected, curated or packed for use on platforms such as TikTok and Instagram.

We aim to film as many orders as reasonably possible, particularly while the business is growing, but not every order will necessarily be filmed or posted.

Purchasing an ordinary order does not guarantee:

That the order will be filmed.
That a video will be published.
When any video will be published.
Any particular number of views, likes, comments or engagement.

Bookish by Cat may change how packing videos are offered in the future, including introducing an optional paid service that guarantees dedicated packing content.

15. Social Media Tags

If you would like to be tagged if your order is selected for social-media content, you may provide your TikTok and/or Instagram username in the personalisation box on the relevant product page.

Providing a username does not guarantee that your order will be filmed.

Where a video is published, Bookish by Cat will make reasonable efforts to use the username provided if a tag has been requested.

If no username is provided, the customer will ordinarily remain anonymous.

Bookish by Cat will not intentionally display private information such as:

Home addresses
Email addresses
Telephone numbers
Payment details
Other information that should reasonably remain private

ORDERS AND CONTRACT FORMATION

16. Placing an Order

When placing an order, you are responsible for checking the information provided before submitting it.

This includes:

Products
Quantities
Add-ons
Personalisation information
Delivery address
Email address
Delivery option
Payment information

The checkout will make clear that submitting the order creates an obligation to pay.

Please contact Bookish by Cat as soon as possible if you discover an error after ordering.

We cannot guarantee that changes can be made once preparation has begun or an order has been dispatched.

Nothing in this section limits applicable statutory cancellation rights.

17. Order Confirmation and Acceptance

When an order is submitted, you may receive an automated order-confirmation email acknowledging receipt of your order.

This acknowledgement does not necessarily mean that the order has been accepted for fulfilment.

Unless otherwise stated, the contract between you and Bookish by Cat is formed when Bookish by Cat confirms that the order has been accepted for fulfilment or dispatches the order.

Payment may be authorised or taken before final acceptance.

If Bookish by Cat cannot accept an order after payment has been taken, the appropriate amount will be refunded.

18. When We May Refuse or Cancel an Order

Bookish by Cat may decline or cancel an order where there is a legitimate reason, including where:

A product is unexpectedly unavailable.
There is an obvious pricing error.
There is a material product-description error.
Payment cannot be authorised.
Delivery cannot reasonably be made to the address provided.
Fraudulent or suspicious activity is reasonably suspected.
An order is clearly intended for unauthorised commercial resale.
Fulfilling the order would be unlawful.
A customer has submitted abusive, threatening or unlawful requests associated with the order.

Any payment due back to the customer following cancellation by Bookish by Cat will be refunded.

19. Product Availability

All products are subject to availability.

Seasonal and other restricted-stock products may sell out quickly.

Adding a product to your basket does not reserve it.

Bookish by Cat may impose reasonable purchase limits on limited-stock products where necessary to manage stock fairly.

PRICES AND PAYMENT

20. Prices

Prices are displayed in pounds sterling (£).

The price payable will normally be the price displayed at the time the order is placed, subject to correction of an obvious error.

Any applicable delivery charge will be shown before payment.

Promotional prices and offers may be withdrawn or changed at any time before an order is placed.

Price changes do not ordinarily affect orders already accepted.

21. Discount Codes and Promotions

Promotional codes:

May have expiry dates.
May apply only to specified products.
May have minimum-spend requirements.
May not be combinable with other offers.
May be limited to one use per customer.
Have no cash value unless expressly stated otherwise.

Bookish by Cat may refuse or cancel use of a promotional code where it has clearly been obtained or used fraudulently or contrary to the stated promotion terms.

Nothing in this section permits Bookish by Cat to retrospectively alter the agreed price of an accepted order without a lawful basis.

22. Payment

Payment must be made using one of the payment methods offered through the Bookish by Cat checkout.

Payments are processed using Shopify and/or the payment provider selected at checkout.

Bookish by Cat does not directly receive or store your full payment-card details.

By submitting payment information, you confirm that you are authorised to use the payment method provided.

SHIPPING AND DELIVERY

23. Shipping Destinations

Bookish by Cat currently ships within the United Kingdom only.

International delivery is not currently available unless expressly introduced at a later date.

24. Processing Time

Unless a product page states otherwise, please allow up to 10 working days for an order to be selected, curated, prepared, packed and dispatched.

Bookish by Cat is a one-person independent business, and every order is prepared by hand.

Working days exclude weekends and UK bank/public holidays.

Processing time is separate from the delivery time after dispatch.

25. Delivery Services and Tracking

Orders are sent using a tracked delivery service.

Depending on the service selected or available, your parcel may be dispatched using Royal Mail or Yodel.

Tracking information will normally be provided once your order has been dispatched.

The delivery provider and service used for a particular order may vary.

Please refer to our Shipping & Delivery Policy for further information.

26. Delivery Estimates

Any delivery times stated by a carrier are estimates unless Bookish by Cat expressly guarantees otherwise.

Bookish by Cat cannot guarantee that a third-party carrier will deliver on a particular day merely because its usual service aim indicates that timeframe.

This does not affect your statutory rights relating to delivery.

Unless another timeframe has been agreed, goods will be delivered within the period required by applicable consumer law.

27. Delays

Order preparation or delivery may occasionally be affected by:

Unexpectedly high demand
Seasonal launches
Promotional events
Bank or public holidays
Announced business closures
Courier disruption
Severe weather
Postal disruption
Circumstances outside Bookish by Cat's reasonable control

Where Bookish by Cat becomes aware of a significant delay affecting an order, reasonable efforts will be made to communicate this to the customer.

Nothing within this section removes any statutory rights relating to delayed delivery.

28. Delivery Address

Customers are responsible for checking that the delivery address supplied at checkout is complete and accurate.

If you realise that an address is incorrect, please contact Bookish by Cat immediately.

Address changes cannot be guaranteed once an order has entered preparation or been dispatched.

Where a parcel is returned because an incorrect or incomplete address was supplied, please contact Bookish by Cat so that the available options can be discussed.

Nothing in this section limits rights where Bookish by Cat or its delivery provider is responsible for a delivery error.

29. Risk During Delivery

Where Bookish by Cat arranges delivery, the risk in the goods remains with Bookish by Cat until the goods come into the physical possession of you or a person identified by you to receive them, subject to applicable consumer law.

Customers will not normally be expected to pursue Royal Mail or Yodel directly for a lost or transit-damaged parcel where Bookish by Cat arranged the delivery.

Please contact admin@bookishbycat.co.uk if an order appears to be lost or has arrived damaged.

RETURNS, CANCELLATIONS & REFUNDS

30. Returns Policy

Returns, cancellations and refunds are governed by the Bookish by Cat Returns, Cancellations & Refunds Policy together with applicable UK consumer law.

For eligible online purchases, customers generally have the right to notify Bookish by Cat that they wish to cancel within 14 days after receiving the goods.

The full return process, applicable exclusions, return-postage arrangements and refund information are contained within that policy.

Nothing within these Terms limits statutory consumer rights.

31. Mystery Bundle Returns

The random nature of a Mystery Bundle does not remove any statutory cancellation right that otherwise applies.

However, simply disliking an individual random selection does not make that item faulty or incorrectly supplied.

Where an entire eligible Mystery Bundle is returned under a change-of-mind cancellation right, the eligible contents forming that bundle must ordinarily be returned together.

Customers cannot keep preferred mystery items while selectively returning unwanted mystery items solely because they are not to their taste.

32. Seasonal Box Returns

Seasonal Boxes may be returned where applicable statutory cancellation rights apply.

Where an entire eligible Seasonal Box is returned because the customer has changed their mind, its eligible contents should ordinarily be returned together.

Individual products cannot ordinarily be exchanged solely because the customer would have preferred a different permitted colour, design, pattern or variation.

Statutory rights relating to damaged, faulty, unsafe, missing or incorrectly supplied goods remain unaffected.

33. Faulty, Damaged, Missing or Incorrect Goods

If an item:

Is faulty
Is missing
Has been incorrectly supplied
Is materially different from its description

Where possible, customers are encouraged to report delivery damage within 48 hours and provide photographs of the product and packaging.

The 48-hour request is intended to help Bookish by Cat investigate transit damage and does not limit or replace your statutory consumer rights.

Depending on the circumstances and applicable consumer law, remedies may include repair, replacement, price reduction or refund.

PRODUCT INFORMATION AND SAFETY

34. Food and Drink Products

Some Bookish by Cat products and Seasonal Boxes may contain packaged food or drink products.

Customers should check:

Ingredients
Allergy information
Preparation instructions
Storage instructions
Best-before or use-by dates
Manufacturer warnings

before consumption.

Customers with allergies, intolerances or dietary requirements should not consume a product unless satisfied that it is suitable.

Where reasonably possible, food and drink products will be supplied in their original manufacturer packaging containing the relevant information.

Please contact Bookish by Cat before ordering if you have a question about an advertised food or drink item.

35. Self-Care and Beauty Products

Some products may contain commercially manufactured self-care, beauty or wellness items.

Customers should read and follow manufacturer instructions, warnings and ingredient information before use.

Do not use a product if you know or reasonably suspect that you are allergic or sensitive to an ingredient.

Discontinue use if irritation or an adverse reaction occurs and seek appropriate advice where necessary.

Nothing within this section limits consumer rights relating to unsafe, faulty or incorrectly described products.

36. Candles and Wax Melts

Where candles, wax melts or other heat-related products are supplied, customers must follow all manufacturer safety information.

Such products should:

Never be left unattended while in use.
Be kept away from children and pets.
Be kept away from flammable materials.
Be used only for their intended purpose.
Be placed on an appropriate stable and heat-resistant surface where applicable.

37. Small Items and Packaging

Some products may contain small components.

Bookish by Cat products are not children's toys unless expressly described as such.

Packaging materials, small parts and other potential choking or suffocation hazards should be kept away from babies and young children.

Any manufacturer age restrictions and safety instructions should be followed.

WEBSITE AND THIRD-PARTY SERVICES

38. Website Accuracy

Bookish by Cat makes reasonable efforts to keep website information accurate and current.

Occasionally errors may occur relating to matters such as:

Product descriptions
Prices
Availability
Promotions
Processing times
Delivery information

Bookish by Cat may correct obvious errors when identified.

If an error materially affects an order already placed, the customer will be contacted where appropriate.

39. Website Availability

We do not guarantee that the website will always be uninterrupted or error-free.

Access may occasionally be restricted because of maintenance, technical issues, security requirements or circumstances outside our reasonable control.

This does not affect rights relating to orders already placed.

40. Shopify and Third-Party Services

Bookish by Cat uses third-party services that may include:

Shopify
Payment providers
Royal Mail
Yodel
Social-media platforms
Other technology or fulfilment providers

Third-party websites and services may operate under their own terms and privacy policies.

Bookish by Cat is not responsible for independent third-party content or systems outside its reasonable control.

This does not remove any responsibility Bookish by Cat has to customers under applicable law, including responsibility for delivery where Bookish by Cat arranged the carrier.

INTELLECTUAL PROPERTY

41. Bookish by Cat Content

Unless otherwise stated, the Bookish by Cat name, branding, logos, original photography, product photography, graphics, illustrations, written content, product descriptions, videos and other original materials are owned by or licensed to Bookish by Cat.

These materials may be protected by applicable intellectual-property law.

You may access and use the website for personal, non-commercial purposes.

You must not, without permission and except where permitted by law:

Reproduce or republish Bookish by Cat content commercially.
Sell or redistribute our original artwork or branding.
Use our content to impersonate Bookish by Cat.
Misrepresent yourself as being affiliated with Bookish by Cat.
Remove ownership notices from protected material.
Use Bookish by Cat branding in a way that is misleading or likely to cause confusion.

REVIEWS AND CUSTOMER CONTENT

42. Reviews, Photographs and Feedback

Customers may voluntarily submit reviews, photographs, feedback or other content.

Where you knowingly provide content to Bookish by Cat for publication or promotional use, you confirm that you have the right to provide that content.

Bookish by Cat may reproduce genuine customer reviews and voluntarily supplied content for reasonable business or promotional purposes where permitted by law.

Reviews will not knowingly be edited in a way that materially misrepresents the customer's opinion.

Bookish by Cat may decline to publish or may remove content that is:

Unlawful
Fraudulent
Abusive
Discriminatory
Threatening
Defamatory
Infringing another person's rights
Unrelated spam

ACCEPTABLE WEBSITE USE

43. Prohibited Use

You must not use the Bookish by Cat website:

For unlawful or fraudulent purposes.
To introduce viruses or malicious software.
To interfere with the security or proper operation of the website.
To attempt unauthorised access to accounts, systems or data.
To infringe intellectual-property rights.
To harass, threaten or abuse another person.
To impersonate Bookish by Cat or another person.
To deliberately submit false or misleading information.
To scrape or commercially reproduce protected website content where prohibited by law.

Bookish by Cat may take reasonable steps to restrict access where serious misuse is identified.

PRIVACY

44. Personal Information

Personal information collected through the Bookish by Cat website is handled in accordance with our Privacy Policy and applicable data-protection law.

Because our online store is operated using Shopify, information required to process purchases may also be processed by Shopify and relevant service providers.

Bookish by Cat does not directly store customers' full payment-card information.

Please refer to the Privacy Policy for detailed information about what information is collected, why it is used, retention, third-party processing and your rights.

LIABILITY AND CONSUMER RIGHTS

45. Statutory Consumer Rights

Nothing within these Terms excludes, restricts or otherwise affects rights or remedies available to consumers under applicable law.

Goods supplied by Bookish by Cat must meet the legal standards applying to them, including requirements relating to satisfactory quality, fitness for purpose and conformity with their description where applicable.

Where a provision in these Terms conflicts with a statutory consumer right that cannot legally be excluded, the statutory right takes precedence.

46. Liability

Bookish by Cat does not exclude or restrict liability where doing so would be unlawful.

Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence where liability cannot lawfully be excluded.
Fraud or fraudulent misrepresentation.
Breach of statutory consumer rights.
Any other liability that cannot lawfully be excluded or restricted.

Subject to applicable law, Bookish by Cat will not be responsible for losses that were not reasonably foreseeable when the contract was formed or losses for which Bookish by Cat is not legally responsible.

Products are sold primarily for personal and domestic use unless expressly stated otherwise.

GENERAL TERMS

47. Events Outside Our Reasonable Control

Bookish by Cat will not be treated as being in breach of these Terms merely because performance has been prevented or delayed by circumstances outside our reasonable control.

Examples may include:

Severe weather
Postal or courier disruption
Transport disruption
Fire or flooding
Power or internet failures
Serious illness or emergency
Government restrictions
Other exceptional events outside our reasonable control

This clause does not remove or reduce any statutory rights you may have, including rights relating to delivery or refunds.

48. Changes to Products

Bookish by Cat may introduce, modify or discontinue products from time to time.

This may include changes to:

Mystery Bundle ranges
Capsule categories
Product examples
Seasonal Boxes
Add-ons
Prices
Website features

Such changes do not retrospectively alter the essential terms of an order already accepted unless agreed with the customer or otherwise permitted by law.

49. Changes to These Terms

Bookish by Cat may update these Terms from time to time to reflect changes to our products, website, business practices or applicable law.

The version applicable to an order will generally be the version in effect when that order was placed.

Statutory consumer rights remain unaffected.

50. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the minimum extent necessary.

The remaining provisions will continue to apply.

51. No Waiver

If Bookish by Cat does not immediately exercise or enforce a right under these Terms, this does not mean that the right has been waived.

52. Transfer of Rights

Bookish by Cat may transfer its rights and obligations under these Terms where permitted by law and where doing so does not adversely affect your consumer rights.

Customers may only transfer their rights or obligations under a contract where Bookish by Cat agrees or where the law permits.

53. Third-Party Rights

Unless expressly stated otherwise, these Terms are between the customer and Bookish by Cat.

No other person has a right to enforce these Terms except where the law provides otherwise.

54. Governing Law and Courts

These Terms and contracts between Bookish by Cat and its customers are governed by the applicable laws of Scotland, subject to any mandatory consumer protections applying to customers elsewhere in the United Kingdom.

Nothing in these Terms is intended to prevent a consumer from relying on mandatory rights available under the law applicable to them or from bringing proceedings in a court in which they are legally entitled to do so.

55. Complaints

If you are unhappy with a product, service or your experience with Bookish by Cat, please contact us so that we can try to resolve the matter.

We will make reasonable efforts to investigate and respond to complaints fairly and promptly.
